Definitions

MRC	MRC Human Capital Services Limited.
PORTAL	U-career.com - the Recruitment Portal operated by MRC.
CLIENTS	Any company / entity using services provided by PORTAL operated by MRC Human Capital Limited.
CANDIDATE	Any person registered as a jobseeker member.
PERSONAL DATA	The PERSONAL DATA of the CANDIDATE includes name, ID number, gender, date of birth, marital status, nationality and correspondence data.
COMPETENCE DATA	Data such as working history, skills, competence, etc.
RESUME	The resume inserted by the CANDIDATE.
FILE INSERTIONS	All files inserted by the CANDIDATE as part of the application for any particular job position.
OTHER SERVICES	Other services provided in this PORTAL, such as Forum, Buy & Sell, etc.

Terms and Conditions

The CANDIDATE using the PORTAL acknowledges that they have read and accepted the terms and conditions as set out below. If you do not accept these terms and conditions, do not use this PORTAL and inform MRC immediately.

1. The CANDIDATE agrees that the use of the PORTAL and services are solely for the purpose of seeking a job and the OTHER SERVICES provided.
2. The CANDIDATE agrees that all information, including their PERSONAL DATA, COMPETENCE DATA and all FILE INSERTIONS to this PORTAL are true and that the contents will not violate any Government rules and regulations.
3. The CANDIDATE agrees that information stored in the PORTAL may remain active for any predetermined period. It is solely the responsibility of the CANDIDATEC to delete / erase their PERSONAL DATA if the CANDIDATE decides to discontinue using the PORTAL services.
4. The CANDIDATE agrees that MRC can charge their CLIENTS for using their PORTAL services.
5. The CANDIDATE agrees that MRC has the right to release their COMPETENCE DATA (without the CANDIDATE’s name) to any CLIENT.
6. The CANDIDATE agrees and accepts that the PORTAL may from time to time send a job alert to the CANDIDATE’s email address.
7. The CANDIDATE agrees that MRC may, without providing any reason, prohibit the CANDIDATE from using any or all the services provided by the PORTAL.
8. MRC agrees not to release the CANDIDATE’s PERSONAL DATA and FILE INSERTIONS to any party, except to the company / entity to which the CANDIDATE has applied for the job.
9. MRC will not be responsible or held liable in any way for any third party using the CANDIDATE’s PERSONAL DATA for any other purposes than for seeking a job.
10. MRC has the right to use the CANDIDATE data for the tabulation of any statistical reports.

Copyright, Trademarks, etc.

The graphics, images, editorial content and HTML on all the MRC's Web Sites are the intellectual property of MRC and are protected by copyright and trademark laws and may not be downloaded or otherwise duplicated without the express written permission of MRC. Re-use of any of the foregoing is strictly prohibited and MRC reserves all rights.

Responsibility

MRC may not monitor its Web Sites at all times but reserves the right to do so. MRC takes no responsibility whatsoever for any material input by any user or others and not posted by MRC. All users acknowledge and agree that they are solely responsible for the form, content and accuracy of any resume, advertisement, web page or material contained therein placed by them. MRC is not responsible for the content of any other web sites linked to MRC's Web Sites; links are provided as internet navigation tools only. MRC does not warrant that any resume, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user. MRC is not in anyway to be considered to be an agent with respect to any users use of MRC's Web Sites and MRC will not be responsible in any way for any decision, for whatever reason made, made by any party seeking or posting jobs on MRC's Web Sites.

MRC DOES NOT WARRANT THAT ITS WEB SITES WILL OPERATE ERROR-FREE OR THAT ITS WEB SITES AND ITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL MECHANISMS. IF USE OF THE WEB SITES OR THEIR CONTENTS RESULT IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, BY ANY USER, MRC WILL NOT BE RESPONSIBLE FOR THOSE COSTS. MRC'S WEB SITES AND THEIR CONTENTS ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, MRC DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT PREJUDICE TO THE FOREGOING, ANY IN RESPECT OF MERCHANTABILITY, NON-INFERINGEMENT OF THIRD PARTY RIGHTS, FITNESS FOR PARTICULAR PURPOSE, OR ABOUT THE ACCURACY, RELIABILITY COMPLETENESS OR TIMELINESS OF THE CONTENTS, SERVICES, SOFTWARE, TEXT, GRAPHICS AND LINKS OF THE MRC'S WEB SITES.

Own Risk

All USERS USE THE MRC'S WEB SITES AND ANY OTHER WEB SITES ACCESSED THROUGH IT, AT ENTIRELY THEIR OWN RISK.

ALL users are responsible for their own communications and are responsible for the consequences of their posting. MRC does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorse any opinions expressed by users. Any reliance by users on material posted by other users will be at their own risk. MRC reserves the right to expel any user and prevent their further access to the MRC's Web Sites, at any time for breaching this Agreement or violating the law and also reserves the right to remove any material which is abusive, illegal or disruptive.

Indemnity

All CANDIDATE’s agree to indemnify and hold harmless MRC and PORTAL, its staff, directors, CLIENTS and agents from any claims, losses and damages arising / resulting from the usage of the PORTAL.

Disclaimer

MRC, PORTAL, their staff, their directors and CLIENTS shall not be liable in any event for any losses or damages suffered by the CANDIDATE.

Limitation of Liabilities

Without prejudice, MRC or PORTAL will not have any liabilities to any CANDIDATE arising from the use of services provided by MRC or PORTAL.

Governing Law and Jurisdiction

This Agreement and any dispute or matter arising from or incidental to the CANDIDATE’s use of the services provided by MRC and / or PORTAL shall be governed by the laws of the Hong Kong Special Administrative Region.
